Urgent advice needed for a friend

Hi ladies,

I've just been speaking to my friend, and I'm after some advice on her behalf on what her rights may be (being a Sunday she can't call anyone)

Her hubby was $800 (2 months) behind on his car repayments (with G.E.)
They had a phone call, saying we'll be there in an hour, then they came and took the car.
They now have 1 month to come up with $2500 ($1700 in legal fees) if they want their car back (it's his work ute - self employed). They also have a 6 week old baby, so things are understandably tight.

Now I've had my share of financial trouble in the past, but I've never heard of anything happening like this after only 2 months? There were no orders issued apparently, they just seized the car.

Does anyone know if the company are within their rights to do this?

Do my friends have any rights??

Not been in the position myself so I can only go on my stepson's experience - he received SEVERAL opportunities to pay up ... and it was SEVERAL times that they called chasing debts and missed payments.

Finally, they issued an order for repossession unless he could bring the debt up to date. So, we footed the $1200 bill - not sure if that was solely missed payments, or if there was a repossession cost (that is, outsourcing to a debt collector/repo agent).

A lot will depend on the conditions of contract he signed up to GE when purchasing the car. I would suggest that they have a look at their contract in the first instance to see what the conditions regarding default/repossession are.

Sounds.very.odd (I wonder whether your friend is saving face by not telling you the whole story?)

That's my immediate reaction too, AC. That either her hubby isn't telling her the whole story, or she's not telling you.

I've never heard of a reposession without lots of opportunities to rectify the debt, and never after only 2 months. Sounds a bit suss to me.

Honestly this does not surprise me with GE because we had the same problems after we moved up here and they did not changed our address when we requested.
They would have been contacted though so I am thinking they have not told all of the story.
GE are ruthless though.

It is also worth noting: GE are the worst place to get a loan through. Massively high interest rates, penalties, hidden fees and fines etc.

I would think it would sound wrong from another lender, but I hate to say with GE, I'm
not surprised.
