Just realised there's only 4 days to go until the application for divorce can be put through.

OK now I'm excited & scared at the same time. Scared because I have no idea what to do.

Do I put it in or wait for him to?
What if both of us does it on the same day?
Then what happens once it's put in?
Does it have to be said on the application if property needs to be settled or is that done later?

OMG I've been in fairy land latel & I didn't realise I knew so little about it

You probably need to speak to him or correspond in some way so you're on the same page. The divorce kit is available from the Family Court website here. If it's an amicable split it should be a joint application so you both pay half the fees. 1 person will be the applicant, the other the respondent. It doesn't matter who files it. Each of you will need to complete details and sign it, witnessed by a JP or similar. What happens after it's filed depends on your situation. Easy if there are no kids involved. A hearing date will be set but if you don't have children you won't need to attend. The court will send you a copy of the sealed divorce certificate once it's ready. Make reference to any other relevant document where indicated. Was it you that had a prenup?

Let me know if you want the name of an excellent family law firm but I think you'll find the divorce papers pretty simple to complete and process. I had a lawyer for the financial settlement but we're handling the divorce ourselves.

Yep I have the prenup.

We have one child together but are happy with half & half care of the kids as we've been doing for the past year & is documented in a parenting plan through mediation.

Basically I have nothing he can really go for financially & I have no interest in anything there. I've lived the past year with what I've built up myself after leaving with nothing so why would I drag myself through more crap. I just want my divorce.

I dont want to attend court if I dont have to & just want it all done.

You'll both need to attend the court hearing since there's a child, but given that you have a parenting plan in place it should be fine. There are 3 aspects of a separation, each handled separately:

1) Finances
2) Child custody
3) Dissolution of marriage

This process is purely for 3: the divorce.

It's been a year today since I left areally bad marriage.
