Changing your name back

Just after some advice on how to go about changing my name back to my maiden name on things like my drivers licence. I still have a passport and of course my birth certificate in my maiden name, do I just use those, or do I have to wait until I have a divorce certifiate before I can change back.

I'm keen to do it because I wasn't 100% sure on changing it in the first place and will be a form of healing and "belonging" to my family again.

I am married and havent changed my name. All i need to prove who I am is my birth certificate. I would imagine you can just go back to using your maiden name, as long as you have your birth certificate. You'd prob have to have your wedding certificate too to prove you were the married name. I cant imagine you would need decree nisi to change it back to maiden name.

At Qld Transport you'll need to have Birth, Marriage & Divorce certificates. I nearly burst into tears when the guy told me I needed the marriage certificate (I didn't bring a copy to Qld with me, why would I?, so I had to order a new one).

However, because you've been known by your maiden name in Qld before, you may be able to change it back without all three certificates if you've got an old licence lying around with your maiden name on it?

I'm sorry I don't have anything particularly valuable to add - I didn't change my name when I got married in the first place - however I have (still am!) gone through a separation so just wanted to give you a virtual hug xx

Thank you so much for all your replies, I didn't even think to check the queensland transport website. I really want to change back, but realised today i may have to wait until I am officially divorced, but I'm still going to change what I can

Ellemjay, thanks so much for the virtual hug, it gets tough sometimes, but I know the separation is for the best, haven't been this happy in a looong time!

I think we're lucky as females in that we can go by any name we like unofficially so while you wait for your divorce paperwork in order to change your licence back, you can still resume being 'maiden name' in the meantime for most other things.

I'm also separated (nearly divorced!) but never really fully assumed my married name so my licence and passport never changed. I did change things like bank accounts though but I've since changed banks and opened new accounts in my maiden name. I was surprised at how simple it all was but then having my licence still in maiden name helped I guess.

Most banks require a divorce cert or a certified statemet stating that you want to start using your maiden name again on existing accounts (this also means any payments by cheque in your married name will be processed with out a problem). So its reasonable simple. I have no idea about DL's or passports - best to look that up on the net.

Hey Jac, I didn't have to wait until I was divorced. I just needed my birth certificate and marriage certificate, so I could prove that I was the same person, and they changed it back for me. Once I had my drivers licence the rest were easy.

Jac, reading the Qld transport link you only need your license, birth and marriage certificate. The banks should only need the same inorder to see who you are now and who you were and why you changed your name. I used to work for the CBA and that's all we needed.

Its not law to take your husbands name so you shouldn't be required to show proof of divorce to change back.

Your maiden name always remains yours and you have the right to use it regardless of whether or not you are divorced - no one has the right to ask for proof of divorce, there is a good section on the bd&m website, sorry can't link it right now

Just to reinterate what the other girls said, I'm not divorced yet, and have changed my name back on everything, just with my marr cert and my birth cert. You dont need to prove you are divorced, you can still be married and change your name back if you want.

Anyone who asks for your proof of divorce, talk to someone higher up, you just don't need it.

Hi Emma
I see that you are from Brisbane the same as me and I am wondering if you have some advice for me. I remarried several years ago and made the mistake of changing my name on my licence but not my passport. I wish to change it back to my previous married name which is the same name on my passport. Which is also my kids names. Can I do this do you think? Thanks in advance. Maddy
