Just wondering what happens with the Certificate of Divorce?

A had a court hearing for the divorce on 20th May, so the divorce should be all done and dusted as of tomorrow (or maybe it's Wednesday, I may have counted wrong unsure.gif). I'm guessing all I need to do now is sit and wait for the Cert of Divorce??

How long does it take to arrive though? I'm kinda looking forward to changing my name back!

hey Gemma - they will send it to you in the post

But you dont need it to change your name - your maiden name is yours, always and forever and you do not need to be divorced to change it back - all you need is a copy of your wedding certificate to show your maiden name on it - and maybe a birth certificate

I don't actually know where my wedding certificate is unsure.gif None of my accounts/licence etc were ever in my maiden name either, given that I'm in a different state now.

A month from the hearing? Or a month from the date it was granted? (Or is that the same day, no they're different dates, right?)

a month from the hearing you should receive a certificate of divorce. This will state the date that the divorce takes effect

Yeh, mine took approx 1 month from hearing to arrive to me in post. This was back in 04.

I didnt go back to my maiden name - more due to the fact that it was such a doozy of a name to try to pronounce and spell to people that my married name was easiest to stay with.

It doesnt hold any meaning to me still having my married name. I am so used to it now that it feels like my single name (and most people think it is my maiden name until I tell them otherwise IF I wish to.).

Did you have to go to court Gems? How come?

All divorces (as far as I am aware) have to go through court, even if it is amicable. You don't neccessarily have to attend, but it needs to be approved by a member before it is granted, especially when children are involved.

If the court approves the divorce then the Decree is made on that day. It is not final at that point - after a month, it becomes absolute (essentially so you can change your mind within a month) and it is not until after that date that the court will send your solicitor (or you directly if you don't have one) the Divorce Certificate. In my experience the Court gets a bit backlogged from time to time and there can be a little delay, so you can always ring them to see how long til the Certificate will be sent or if it has already been sent.
